HILLIARD TO JOIN U.S. SENATORS IN CALLING FOR JUST COMPENSATION FOR GM VICTIMS
CORPUS CHRISTI, Texas (April 20, 2015) Bob Hilliard, Founding Partner at Hilliard MuÃ±oz Gonzales, LLP, and lead counsel for the national personal injury and death litigation pending in the Southern District of New York and who currently represents 1,041 individuals who suffered injuries or lost loved ones as a result of the now infamous General Motors ignition switch defects, will join U.S. Senators Richard Blumenthal (D-Conn.) and Bill Nelson (D-Fla.) in demanding the establishment of a fair compensation process for victims, after a federal bankruptcy court ruled last Wednesday that GM was shielded from liability under the terms of its 2009 bankruptcy. The event will take place on Tuesday April 21, 2015 at 12 p.m. in the Senate Swamp, across from the U.S. Capitol Senate Steps.
Also at the event will be Mark and Samuel Averill from Connecticut whose mother, Jean P. Averill, lost her life in 2003 due to a GM ignition switch defect. The defects have been linked to at least 84 deaths and led to the recall of some 2.6 million vehicles in 2014.
Last Wednesday Judge Robert E. Gerber of the U.S. Bankruptcy Court for the Southern District of New York issued a ruling that effectively denies plaintiffs the opportunity to bring claims against GM for wrongful death and injuries sustained as a result of GMâ€™s ignition switch defects. This shield from liability prevents as much as $10 billion in claims from being brought against GM, despite its having full knowledge of the defects and taking active steps to conceal them from the public and the bankruptcy court.
â€œNo way GM would have had the protection it now enjoys had it disclosed in 2007-2009 what it finally disclosed in 2014. For GMâ€™s lawyers to keep this information in their briefcase at the sale hearing does truly make them the devilâ€™s advocate,â€ remarked Mr. Hilliard. An appeal to the Second Circuit is currently being prepared.
â€œThe Opinion state[d] that â€˜pre-sale accident victims were not prejudiced by the denial of due process the Judge found occurred. Respectfully, that is flat wrong,â€ said Mr. Hilliard of the ruling. â€œMy clients never had their day in Court. They never had an opportunity to appear at the sale hearing when things still mattered and were still unsettled.â€
And while the legal process with regard to this ruling is far from over, victims are already being required by GM to waive their legal rights, in an effort to prevent their participation in the compensation fund currently being administered to bring relief to victims of the first two GM recalls.
This event is being organized to demand that GM victims are not forced to waive any of their legal rights until the court process concludes.
