Nueces County Jury Awards $6.4 Million to an Elderly Injured at a Christus Spohn Medical Complex

(CORPUS CHRISTI, Texas) – The law firm of Hilliard Muñoz Gonzales LLP is pleased to announce that a Nueces County jury has awarded their client, 89-year old Bennie Garcia, $6.4 million in damages.  Ms. Garcia was severely injured in July of 2009, when a sliding glass door at the Christus Spohn South Professional building, 5950 Saratoga Blvd., slammed into her, throwing her violently to the ground and fracturing her hip.

“Ms. Garcia went from being an active and independent grandmother to an invalid.  She now has to wear diapers, have someone feed her and help her with all other basic needs,” said attorney Bob Hilliard of Hilliard Muñoz Gonzales LLP. “This accident left Ms. Garcia in severe pain and dramatically changed her life.”

“Christus Spohn needs to have a preventative maintenance plan in place for the sliding doors at all of its facilities, especially buildings where the elderly, sick and infirm walk on a daily basis,” Hilliard continued. “The hospital had been told by the door company that the ‘presence sensor’ on this

specific door was in need of replacement since 2004 and did nothing. That same broken sensor is still in the door today.”

Ms. Garcia has had two pins and two plates put into her right hip. The four-day trial was held in the Nueces County Court At-Law No. 4 with Judge James Klager presiding. The jury found that Christus Spohn Health System was 100% responsible for Ms. Garcia’s injury and awarded $3.2 million for past damages including physical pain, mental anguish, disfigurement and medical care expenses paid or incurred.  The jury awarded $3.2 for future damages.

“Elderly people have an absolute right to a quality of life. What is your dignity worth? The injuries caused by Spohn stripped this beautiful 89-year old, mother of nine children, of her independence and that dignity. She deserved to spend the evening years of her life enjoying her family and friends,” Hilliard said.

Mr. Hilliard's picture and mention of recent accolades appeared several times during rush hour in the Big Apple on Tuesday.  Recently, Mr. Hilliard was named as one of the Top 100 Trial Lawyers in Texas by the National Trial Lawyers and he was selected as a finalist for the Public Justice Foundation's National Trial Lawyer of the Year award. Congratulations Bob!

Mexico Offers Additional Legal Support for Family of Mexican Teen Shot and Killed by a United States Border Patrol Agent 
 
 
(EL PASO, Texas) – The Mexican government, through the office of the Ministry of Foreign Affairs and Consulate General in El Paso, has offered the attorneys for the parents of 15-year old Sergio Adrián Hernández Güereca additional legal firepower to appeal a recent United States District Court decision.
 
Hernández Güereca, a citizen of the Republic of Mexico, was shot and killed by a Border Patrol agent on June 7, 2010. On August 11, 2011 Senior U.S. District Court Judge David Briones dismissed Hernández Güereca’s parents’ case against the United States government (EP-11-CV-027-DB) without prejudice, but ruled that the case against the agent, Jesus Mesa Jr., could proceed separately.
 
“Mexico understands the meaning of what has happened.  The United States can now order its border patrol agents to use any citizen of Mexico for target practice. Shoot at will. Shoot freely. Shoot without provocation.  As long as the targeted Mexican national is on their home soil of Mexico when they are shot, there can be no consequences to the U.S. government,” said Hernández Güereca family attorney Robert Hilliard of Hilliard Muñoz Gonzales L.L.P.
 
In a letter sent out last week, the Acting Director General of Mexico’s Ministry of Foreign Affairs instructed the Chicago-based law firm of Hughes, Socol, Piers, Resnick and Dym Ltd. to provide support for Hilliard and his co-counsel, Cristóbal Galindo of the Galindo Law Firm in Houston.  Hilliard and Galindo are representing Maria Guadalupe Güereca Betancour and Jesus Hernandez in the lawsuit.

Attorneys have filed a Notice of Appeal with the United States Court of Appeals Fifth Circuit.

Attorneys to Appeal U.S. District Judge’s Ruling
in the Deadly Shooting Case of a Mexican Teen by a U.S. Border Patrol Agent
 
 (EL PASO, Texas) – Attorneys for the family of 15-year old Sergio Adrián Hernández Güereca say they will appeal a ruling handed down on Wednesday by Senior U.S. District Judge David Briones regarding the shooting death of the teenager back on June 7, 2010.
 
In the ruling, the Court ordered that all claims against the United States, including the Department of Homeland Security, Border Patrol and Bureau of Customs and Border Protection, are dismissed citing several cases, but most prominently the case Sosa v. Alvarez-Machain, 542 U.S. 692 (2004).
 
“We find it interesting that the Court has allowed us to continue with legal action against the Border Patrol agent involved, but has said his employers cannot be held responsible even though the agent was trained by the government, on-duty, in uniform, and standing on American soil when he fired his gun across the border to shoot and kill Sergio,” said family attorney Bob Hilliard of Hilliard Muñoz Gonzales LLP.
 
“The Court is citing and relying on a case that is very distinguishable from our case. In that instance, U.S. law enforcement planned the capture of a Mexican national.  The planning took months.  In our case, Agent Jesus Mesa was standing 10 feet from Sergio.  The entire sequence of events took less than 10 seconds, there was no planning.  He raised his firearm and shot Sergio twice in the head,” Hilliard continued.
 
Hernández Güereca, a citizen of the Republic of Mexico, and a group of friends were playing in a concrete drainage culvert when the shooting occurred last year. His body was found under the Paseo Del Norte Bridge in the territory of Mexico.
 
“Agent Mesa’s attorneys have also filed a motion to dismiss the case saying basically that the Constitution doesn’t apply to Aliens,” Hilliard said.  “They are wrong. This will be an interesting fight, but we are not backing down.  Agent Mesa shot and killed an unarmed teenager.  He is employed by the government.  The family wants answers and we’re going to help them get those answers. Period.”
 
Hilliard and Houston-based attorney Cristóbal Galindo, Galindo Law Firm, are representing Güereca’s parents, Maria Guadalupe Güereca Betancour and Jesus Hernandez in the lawsuit. 
 
The lawsuit was originally filed in U.S. District Court back on January 17, 2011. Attorneys have 60 days to file an appeal with the United States Court of Appeals Fifth Circuit.
